Legal malpractice may come about because an attorney took on a case that was outside their area of proficiency. They may have been overworked, and for that reason, neglected to prepare a case properly.

A legal malpractice attorney has a double responsibility on behalf of a client who was wronged by another lawyer's negligence. First, the underlying "case within a case" must be litigated. The result of this undertaking should be a determination of the value of the case that was neglected or mishandled. Secondly, a detailed account of the professional negligence must be investigated and documented.
